The Supreme Court (SC) rejected the petition, in which the establishment of a temporary mega vaccination center for coronavirus disease (COVID-19) at Nayong Pilipino in Pasay City was challenged.

In a resolution promulgated on June 15 and published on July 21, the petition of the former mayor of Boac, Marinduque, Pedrito M. Nepomuceno, for an injunction from Kalikasan was scrapped by the SC.

Nepomuceno claimed that di e Establishing the mega vaccination center would result in the felling of trees that would destroy the environment.

He also claimed that the proposed vaccination center did not undergo the mandatory environmental impact assessment and did not have an environmental compliance certificate from the Ministry of the Environment and Natural Resources ( DENR).

The respondents named in the petition were President Duterte as general chairman of the Inter-Agency Task Force on Emerging Infectious Disease (IATF); Secretary Francisco Duque, III, Chairman of the IATF; Carlito G. Galvez, Jr. of the Joint Task Force Covid-19 Shield, Secretary Roy Cimatu of the Department of Environment and Natural Resources (DENR), and Secretary Bernadette Romulo Puyat of the Department of Tourism (DOT).

Last April The IATF approved the establishment of a temporary mega-vaccination center on reclaimed land on the Nayong Pilipino Compound in Pasay City.

The IATF then authorized the National Task Force against COVID-19 to sign a Memorandum of Agreement with the Nayong Pilipino Foundation (NPF) to build the vaccination center.

The NPF rejected the project because it will cut almost 500 trees. Nepomuceno submitted his petition on May 11th.

“Here Nepomuceno’s petition suffered from formal deficiencies. First and foremost, the petition was unsigned, unconfirmed, and without a certificate of shopping outside the forum.

“Worse, the petition lacks proof of service to the opposing parties and payment for the Sheriffs Trust Fund.

“In view of the content requirements, neither the violated or violated environmental laws nor the environmental damage was identified in the petition to such an extent that the life, health or property of the residents in two or more cities or provinces are affected, to justify the issuance of a Writ of Kalikasan.

“Nor did the petition show the officials’ unlawful failure to take any action expressly required by environmental law to support his request for a Writ of Continuing Mandamus to be issued.

“Nepomuceno’s appeal to the state’s responsibility to protect and promote the right of people to a balanced and healthy ecology and to preserve and protect the environment without identifying the illegal acts or omissions of the defendants, is not sufficient to justify the issuance of the requested pleadings.

“It is noteworthy that the petition is not supported by any material evidence other than online articles discussing the proposed vaccination center.

“Truly, unchecked news articles on the Internet are hearsay evidence that has been removed twice and is therefore of no probative value.

” All in all, the petition is inadequate both formally and in terms of content. For these reasons the petition is REJECTED. “
